General Terms and Conditions (GTC)
darkdiving – Owner Thomas Dunkel

1. Scope
These General Terms and Conditions apply to all services provided by darkdiving, owner Thomas Dunkel (hereinafter referred to as "darkdiving") towards customers, in particular for diving courses, accompanied dives, training courses, and other offers.
Any deviating or supplementary agreements must be made in writing. By registering for a course or dive, the customer accepts these terms and conditions.
2. Registration and conclusion of contract
Registration can be done online, by telephone, in writing, or in person.
A contract is concluded upon confirmation by darkdiving came about.
The customer assures that all information provided (in particular regarding health and diving experience) is true and accurate.
3. Data protection
I have read the privacy policy of darkdiving I have read and fully accept them.
In order to conduct courses and issue certifications, personal data (name, date of birth, email address, course information) is transmitted to the respective training association (e.g., PADI).
Medical information is used exclusively for the purpose of assessing fitness for diving and will not be disclosed to third parties.

4. Course fees and payment terms
The course fee is due upon registration.
A course date is only considered to be bindingly reserved once full payment has been made to the account specified on the invoice.
If payment is not received within 7 days of registration, the course place may be allocated to another participant.
5. Cancellation by the customer
A processing fee of 50,00 € collected.
Course materials that have already been issued or activated (e.g., PADI E-Learning) are non-refundable.
The cancellation must be made in text form (Email is sufficient). The date of receipt by darkdiving is decisive.
6. Cancellations / Cancellation policy
Booked diving courses and diving dates are binding reservations.
If participation is not possible, the following cost regulations apply:

Cancellations due to illness with a doctor's note are excluded from this.
darkdiving reserves the right to postpone appointments for safety reasons (e.g., weather, illness of the diving instructor, technical defects). In this case, no additional costs will be incurred.
7. Lack of course preparation
Insufficient preparation (e.g., incomplete theory or e-learning modules) may result in exclusion from the course day.
The cost of any necessary make-up sessions is 100% of the daily course price.
8. Course discontinuation
In the event of premature termination of the course, only unused services will be reimbursed on a pro rata basis.
Course materials that have already been handed out are excluded from reimbursement.
Dropping out due to illness with a doctor's note is an exception to this.
9. Refresher training / additional lessons
Any required refresher training days or additional lessons can be charged at a pro-rata daily course price.
Refresher courses are subject to availability; there is no entitlement to immediate continuation.
10. Course duration
The course must be completed within 12 months after registration be completed.
After this period has expired, the right to continuation shall lapse unless a written extension has been agreed.
In the event of a proven delay due to illness, the deadline shall be extended accordingly (maximum 6 weeks).
11. Photo and video release
Photographs and videos may be taken during courses and events.
By giving their consent, participants agree that these recordings may be used by darkdiving for promotional purposes (website, social media, print materials) free of charge.
This consent may be revoked at any time with effect for the future.
12. Liability
Diving is a potentially risky sport.
The participant undertakes to follow the safety instructions of the diving instructors and to comply with the applicable diving rules.
darkdiving is only liable for damages resulting from intentional or grossly negligent conduct can be attributed to.
No liability is accepted for accidents caused by the user, health risks, or loss of property.
13. Severability clause
Should individual provisions of these General Terms and Conditions be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
The statutory provision shall apply in place of the invalid provision.
14. Place of jurisdiction and applicable law
The law of the Federal Republic of Germany applies.
The place of jurisdiction is – to the extent permitted by law – the registered office of darkdiving.
